SUBCHAPTER I. GESTATIONAL AGREEMENTS

 

What you should know:

​

  • Parentage is ordered (pre-birth order) with the gestational agreement being validated by the court, mid-pregnancy, per its contractual requirements for surrogacy.

  • Intended Parents must be married to each other.

  • Intended Mother's or donor's eggs must be used. The gestational carrier may not use her own eggs.

  • A gestational agreement may not limit the right of the gestational mother to make decisions to safeguard her health or the health of an embryo.

  • The Intended Mother must have a medical or mental health issue issue that reasonably prevents her from carrying  the pregnancy safely.
